These Terms of Service ("Terms") govern your access to and use of the website, community, content, templates, communications, programs, and other services (collectively, the "Services") provided by Hobdell Consulting LLC and D&J Digital Marketing Pty Ltd ("we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our Services.
You must be 18 years or older to access or use our Services. By using our Services, you confirm that you meet this requirement.
To access certain Services, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use.
Our use of personal information is governed by our Privacy Policy. Please read it to understand how we collect and use your data.
You agree to use our Services only for lawful purposes and in accordance with these Terms. You will not use the Services:
Our business offers services across multiple tiers. Each tier has its own payment terms, commitments and refund conditions.
Enrolment in any mentoring or training programme is for a fixed term of 12 months. By enrolling, you agree to the full 12 month financial commitment, regardless of participation, usage, attendance or changes in personal or business circumstances.
You may choose from:
a. Upfront Payment
A single upfront payment made at the time of booking.
You may pay upfront by card, bank transfer or approved instalment providers such as Zip.
b. Monthly Payments
A monthly payment plan over 12 consecutive months.
The full 12 month balance is payable even if you stop participating.
All mentoring programme enrolments include a 7 day cooling-off period from the date of booking.
During this period you may cancel and receive a full refund if:
You have not accessed more than one call or session, and
You have not downloaded or used paid templates, calculators or resources.
If programme materials have been accessed or used, we may charge a reasonable fee for services delivered.
After the cooling-off period, all mentoring payments are non-refundable.
Cancellations do not release you from your remaining financial commitment.
If a monthly payment fails or falls into arrears, the full remaining balance for the 12 month term becomes due immediately.
If you choose to use Zip or another instalment finance provider, all repayment obligations are strictly between you and the finance provider.
We are paid upfront by the provider and cannot pause, cancel or modify your repayment agreement.
Any questions about repayments or account management must be directed to the finance provider.
Fractional CFO Services operate on a monthly recurring retainer.
There is no fixed-term contract unless agreed otherwise in writing.
You may cancel your monthly CFO retainer at any time by giving written notice.
Your cancellation will take effect at the end of the current billing cycle.
All payments for completed or current billing periods are non-refundable.
Some Services may be delivered on a subscription basis. Subscriptions automatically renew unless cancelled before the renewal date. You may request a pause in subscription access, subject to approval.
Inactivity does not count as cancellation.
All content, templates, designs, training materials, videos, branding and other materials provided through the Services are owned by us or licensed to us. You may not copy, share, distribute, reproduce or modify any part of the content without our written permission.
We use third-party platforms including GoHighLevel, Meta, Google and others to deliver our Services. The Services may contain links to external websites. We are not responsible for their content, privacy practices or actions.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, including lost profits, data loss or business interruption arising from your use of the Services.
The Services are provided on an as is and as available basis. We do not guarantee any specific financial outcome or business results. You are responsible for your own decisions, actions and results.
These Terms shall be governed by the laws of the state of Australia for D&J Digital Marketing Pty Ltd, and the laws of the United States for Hobdell Consulting LLC. You agree to submit to the jurisdiction of the courts located in your country of residence or in Australia.
We may suspend or terminate your access to the Services if we believe you have violated these Terms. Termination does not release you from any payment obligations already incurred.
We may update these Terms from time to time. Your continued use of the Services after updates are posted constitutes acceptance of the revised Terms.
